Terms of use

The rules for using KAWN, the platform that connects designers, client companies and engineers to take designs from concept to fabrication.

These terms

These terms are an agreement between you and [KAWN legal entity name], [registered address] ("KAWN", "we"). By creating an account, accepting an invitation or using KAWN you accept them and our Privacy notice. If you use KAWN for a company, you confirm you may bind it to these terms.

Who can use KAWN

  • You must be 18 or over and able to enter a binding contract.
  • Designers create their own account and confirm their email address. Clients, engineers and KAWN staff join by invitation from KAWN.
  • An account is for one person. Keep your password secret, keep your details accurate, and tell us at once if you think someone else has used your account.

Roles on the platform

  • Designers upload designs, set their price and payment terms, answer client briefs and refine concepts with clients.
  • Clients discover designs, request purchases or modifications, publish briefs and select responses, and request engineering.
  • Engineers take on engineering jobs and deliver engineering packs.
  • KAWN administrators curate listings, confirm purchases, keep fee records and moderate the platform, each within the permissions of their role.

Your uploads and intellectual property

  • You keep the intellectual property in what you upload. You confirm that you own it or have the right to upload it, and that it does not infringe anyone’s rights or break the law.
  • You give KAWN a non-exclusive, worldwide, royalty-free licence to host, copy, resize, scan and show your uploads to the users the platform rules allow, for as long as needed to run the platform and keep the records these terms describe.
  • Images and descriptions of a listed design are shown according to the visibility you choose. Source and technical files stay locked until KAWN confirms a purchase, and then unlock for the buying company only.
  • What a buyer may do with a design after a confirmed purchase (full payment or royalty, the scope and territory of use) follows the terms agreed for that purchase. [Intellectual property transfer and licence terms per payment structure to be set by counsel.]

Purchases, briefs and engineering

  • Prices are in UAE dirhams (AED). A purchase request is not a sale until KAWN confirms it, after the commercial terms and payment are confirmed outside the platform.
  • KAWN does not process payments on the platform. Invoices and payments are handled directly by KAWN with each party, and the platform records the outcome as fee records.
  • Selecting a brief response starts a concept refinement; the concept is complete only when the client approves it.
  • An engineering job is offered to KAWN engineers. The engineer who accepts it delivers the pack by the deadline; the client closes the job when it is delivered.

Fees

KAWN keeps a fee record for each paid engagement (a design purchase, a design for hire and an engineering job) with the amount, the agreed payment structure and its status. KAWN earns a commission on these engagements at the rate in force when the fee is paid. Payment terms for designers and engineers are agreed with KAWN. Acceptable use

You must not:

  • upload anything unlawful, infringing, defamatory or harmful, or any malware;
  • try to reach data, files or accounts you are not entitled to, or get around a limit or a lock;
  • copy or scrape the platform or its content in bulk, or use it to send unsolicited messages;
  • harass, threaten or deceive other users, or impersonate anyone;
  • misuse another person’s design, or use a design beyond what a confirmed purchase allows.

KAWN may review chats and listings when a problem is reported or a dispute needs it. Every such review is logged.

Moderation, suspension and closing an account

  • KAWN may hide a message, remove a listing, block a company or disable an account that breaks these terms or the law, and records the reason.
  • You can stop using KAWN at any time and ask us to erase your account by writing to [privacy contact email]. We keep the records the law or a contract requires, as the Privacy notice explains.

Availability and liability

We work to keep KAWN available and secure but provide it as it is, and may change or pause parts of it for maintenance or improvement. Designs, briefs and engineering packs are the work of the users who provide them; KAWN does not guarantee their fitness for a particular use. [limitation of liability to be set by counsel]

Changes to these terms

The version and date at the top of this page change whenever we change these terms. When a change matters, we ask you to accept the new version before you continue using KAWN.

Governing law and disputes
